Media Trial: Menace To The Justice System - A Comparative Study Of Indian Law

Abstract The article is an in-depth legal analysis of media trials. The paper analyses the constitutionality of media trials in light of Article 19(1)(a), the freedom of speech and expression, and examines the need for reasonable restrictions to be put on the freedom of press to ensure the efficient administration of justice. Media trials are also assessed in view of right to fair trial, crucial to the accused and the smooth functioning of the criminal justice system. Further, the paper analyses the Contempt of Courts Act of 1971 and how its principles invalidate media trials. Lastly, the paper explores the impact of media trials in the form of prejudice and pressure on the judiciary and its potential of obliterating the right to fair trial, a right of utmost importance to the accused, lowering their dignity, violating their privacy and obstructing justice.
